Terms & Conditions:
These Terms & Conditions (the “Terms”) govern your purchase of and participation in the Fertility Whispers program (“Program”) provided by Holistic Pincups ("Provider", “we”, “us”). By enrolling in or accessing the Program, you ("Participant", “you”) agree to the following Terms:
1. Program Description & Scope
1.1 Nature of Services. The Program provides group education and emotional‑wellbeing support (including reflective practices, self‑regulation tools, and faith‑aligned guidance). It is not medical care, mental‑health treatment, psychotherapy, counselling, crisis intervention, or a substitute for any medical professional advice.
1.3 Age & Capacity. You confirm you are 18 years or older and capable of entering into these Terms.
2. Enrolment & Access
2.1 Registration. Enrolment requires accurate information and payment of fees. We may accept or decline enrolment at our discretion.
2.3 Recordings Hub. If applicable, session recordings are made available via a private Recordings Hub from the date of upload. We may edit or withhold a recording to protect privacy or safety. Downloading or re‑sharing is prohibited.
3. What’s Included / Not Included
3.1 Included: live group sessions as scheduled; access to recordings during the Access Window; designated resources (exL type‑specific PDF, eBook etc); support emails; and community space if offered.
4. Participant Responsibilities
4.1 Self‑care & Boundaries. You agree to care for your wellbeing (e.g., step away, camera off, pause sharing) and to use crisis resources where needed.
4.3 Accuracy. Information you provide (including in intake forms) will be true and up‑to‑date.
5. Fees, Payments & Refunds
5.1 Fees. Fees are stated at checkout in GBP and may be subject to VAT.
5.3 Refunds available up to 7 days before start; no refunds will be issued after materials or recordings are accessed.
6. Schedule & Changes
6.1 Timetable. Dates and times are stated on the Program page and/or confirmation email
7. Group Setting, Confidentiality & Safety
7.1 Group Confidentiality. We request all participants keep group discussions confidential. However, because this is a group setting, confidentiality from other participants cannot be guaranteed.
7.3 Safety. We may remove or pause a participant to safeguard the group or an individual.
8. Data Protection & Privacy
Privacy 1) What we collect •Contact & identity: name, email, country/time zone. •Program data: quiz answers and personality result, intake form responses, preferences, attendance, feedback. •Communications: emails you open/click, messages you send us. •Recordings: if you attend live sessions with camera/mic on. •Technical: IP address, device/browser info, cookies (see Cookies). •Payments: processed by our payment provider (e.g., Stripe/Revolut). We do not store card details. 2) Why we use your data (purposes) •Deliver the program: register you, send materials, run sessions, provide recordings during the access window. •Personalise support: tailor emails/resources based on your quiz and intake. •Communicate: confirmations, reminders, updates, and support replies. •Improve & safeguard: quality checks, troubleshooting, usage analytics, security. •Legal & admin: invoices, accounting, fraud prevention, compliance. 3) Our legal bases We rely on one or more of: your consent (ex: optional marketing, testimonials), contract (to deliver what you purchased), legitimate interests (to improve and keep things secure, to send essential program emails), and legal obligation (records we must keep). 4) Who we share with We use reputable service providers (processors) to run the program, for example: •Typeform (quiz/intake), Flodesk (emails), Zoom (live sessions), Google Drive (files), payment processor (checkout). These providers process your data only to help us deliver services and are bound by contracts. We may also share data if required by law, to protect rights/safety, or during a business reorganisation. 5) Recordings and community privacy •Purpose: allow enrolled participants to catch up. •Access: recordings are available in the Recordings Hub for 1 to 3 months at our discretion. •Controls: you may keep your camera off and change your display name. •Limits: please do not download, screen-record, or share recordings. We may edit or withhold a recording to protect safety or privacy. 7) How long we keep data We keep personal data only as long as needed for the purposes above: •Program admin and emails: while you participate and for at least 12 months, after, unless you ask us to delete earlier (where applicable). •Recordings: for the access window then deleted or archived securely. •Finance/transactions: kept as required by law 8) Your choices and rights Subject to applicable law, you may: •Access, correct, or delete your personal data. •Object or restrict certain processing. •Withdraw consent where processing is based on consent (e.g., marketing). •Unsubscribe from non-essential emails at any time. •Complain to a data authority if you believe your rights were infringed. To exercise rights, email shanela@holisticpincups.co.uk 9) Security We use reasonable technical and organisational measures to protect your information (account controls, limited access, encryption in transit where supported). No system is perfectly secure; we will notify you of any high-risk breach as the law requires. 10) Children Our program is for adults 18+. We do not knowingly collect data from children. 11) Marketing and testimonials We only send marketing with your opt-in consent. You can unsubscribe anytime. We only use testimonials, name/initials, image, or voice with separate explicit consent. 12) Cookies and analytics We may use necessary cookies for site operation and optional cookies or similar tech for analytics and email performance. You can adjust your browser settings to block cookies or opt out of analytics where offered. 13) Changes to this notice We may update this notice from time to time. Material changes will be communicated via email or on our site. The “Last updated” date shows the latest version.
8.3 Retention. We retain data only as long as necessary for Program delivery, legal obligations, and legitimate interests.
9. Intellectual Property & License
9.1 Ownership. All Program content (including brand names, curriculum, slides, PDFs, eBook, emails, videos/recordings, templates, and websites) is owned by the Provider (holistic pincups / shanela).
9.3 Prohibited Uses. You will not copy, distribute, resell, teach from, publicly display, create derivative works of, or use the materials to train AI models or datasets without prior written consent.
10. Testimonials, Name & Likeness (Opt‑In)
10.1 We will only use your testimonial with name, image, or voice for marketing with your separate, explicit consent. You may withdraw consent for future use at any time by contacting shanela@holisticpincups.co.uk Testimonials or clips without name, image or any form of clear resemblance to you may be used for promotional purposes.
11. Disclaimers; Limitation of Liability; Indemnity
11.1 Disclaimers. The Program is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of fitness for a particular purpose and non‑infringement.
11.3 Indemnity. You will indemnify and hold us harmless from claims, losses, and expenses arising from your breach of these Terms, misuse of content, or unlawful conduct.
12. Code of Conduct & Removal
12.1 Conduct. This is a compassion‑first space. Harassment, hate speech, bullying, spamming, solicitation, or disruption are prohibited.
13. Termination
13.1 By You. You may withdraw from the Program at any time; refunds (if any) are per Section 5.3.
14. Force Majeure
14.1 We are not responsible for delay or failure to perform due to events beyond our reasonable control, including but not limited to acts of God, war, epidemics, governmental actions, internet outages, or platform failures.
15. Notices
15.1 Method. Notices may be delivered by email to the addresses you or we provide. Notices are deemed received upon successful transmission. Keep your contact details current.
16. Changes to Terms or Program
16.1 We may update these Terms or aspects of the Program to reflect legal, safety, or operational needs. Material changes will be notified by email or on the Program site. Your continued participation after notice constitutes acceptance.
17. Entire Agreement; Assignment; No Waiver; Severability
17.1 These Terms (with the Privacy Notice and any order/checkout summary) form the entire agreement and supersede prior communications.
17.3 No waiver of any term is a further or continuing waiver.
18. Governing Law & Dispute Resolution (DIAC Arbitration)
18.1 Governing Law. These Terms are governed by the laws of the United Kingdom.
18.3. If still unresolved, any dispute shall be finally settled by a neutral third party - the mediator.
19. Electronic Acceptance
19.1 You agree that your online checkout, form submission, or typed name/signature constitutes your electronic acceptance of these Terms, equivalent to a signed written agreement.
